While we include a pour-over will with all of our clients’ trusts, we don’t intend to use it. Because ideally, you would title any future-acquired real estate directly into your trust. But in the event of an oversight, a pour-over will can do this for you, but it will only do so through probate. So, for instance, if you bought a future property in Arizona, and didn’t get it titled into the name of your trust, that Arizona property could be subject to probate. Now, the pour-over will would state that any assets that are subject to probate are to be distributed in accordance with the terms of your trust, that property would likely have to go through probate in order for it to get into your trust.
